This cancellation policy is designed to be fair and equitable for our clients and potential efforts made by staff and/or third parties. With its foundation in the timing of the withdrawal or cancellation and the surrounding circumstances. Maya Blue Dive Center recognizes that despite our best efforts to provide superior quality service occasionally unexpected events might occur, therefore we continue to be transparent in our policy to prevent any disappointments.
1.1 Maya Blue Dive Center encompasses any staff, any representative and subcontractors.
1.2 This cancellation policy applies on online bookings, including those made by third-parties, as well as any direct purchases at Maya Blue Dive Center.
1.3 The main rule applies when a payment for a booking and/or purchase is received, Maya Blue Dive Center initiates arrangements to deliver high quality standards. Once Maya Blue Dive Center have received a full payment, this is non-refundable, except as outlined below.
1.4 Once departed, from either Maya Blue Dive Center or by pick-up service from the client’s accommodation, the activity will be considered to be taking place from this moment on.
1.5 With respect to activities requiring certification, it is the client’s responsibility to provide the proof prior to the activity.
1.6 Clients must acknowledge that the activity is within their physical capacity. In principle, clients can participate in the activity in case of a pre-existing medical condition if a recognized physician declares that there are no medical complications for the particular activity involved.
1.7 Regarding all activities clients agree to abide by the rules, training standards, safety standards, regulations, laws and decisions of Maya Blue Dive Center.
2. Changes and cancellation by clients
2.1 If the client cancels more than 30 days before the activity would take place, the client will be given either a personalized voucher or a full refund minus the administrative charge of 8,5% of the payment received.
2.2 If the client cancels less than 30 days and more than 14 days prior to the course, the client will be given a refund of 50% of the payment received.
2.3 If the client cancels less than 30 days and more than 14 days prior to the course due to a medical complication which do not allow the client to participate in the activity. Maya Blue Dive Center will require proof though a medical statement from a recognized physician. Maya Blue Dive Center will make every effort to reschedule. Whenever rescheduling is not an option the client will be given a personalized voucher, valid for 5 years. Maya Blue Dive Center will also allow the client to have someone to replace for the scheduled activity, with explicit approval of the client.
2.3 If the client cancels within 14 days prior to the course, this will result in no refund.
2.4 If the client cancels within 14 days prior to the course due to a medical complication which do not allow the client to participate in the activity. Maya Blue Dive Center will require proof though a medical statement from a recognized physician. Maya Blue Dive Center will make every effort to reschedule. Whenever rescheduling is not an option the client will be given a personalized voucher, valid for 5 years. Maya Blue Dive Center will also allow to have someone to replace the client for the scheduled activity, with explicit approval of the client.
2.5 When activity is taken place, no refunds will be given for any cancellations.
2.6 No-shows and/or missed sessions will result in no refund.
3. Changes and cancellation by Maya Blue Dive Center
3.1 Although it’s unlikely that Maya Blue Dive Center will make any changes and every effort will be made to adhere to the scheduled bookings, Maya Blue Dive Center will reserve the right to do so at any time. In the event Maya Blue Dive Center makes changes, other than described in the below articles 3.2 – 3.8, Maya Blue Dive Center will do its utmost best to reschedule. If rescheduling appears not to be an option for the client, client will be given either a personalized voucher valid for 5 years or a full refund of payment.
3.2 Maya Blue Dive Center reserves the right to charge an administrative fee for any amendments requested by the client. This fee may be charged at the discretion of Maya Blue Dive Center.
3.3 All activities offered are weather dependent. In instances that the weather obstructs the booked activity Maya Blue Dive Center will do their utmost best to provide an alternative option. Whenever rescheduling is not an option, Maya Blue Dive Center will either give a personalized voucher or full refund of the payment minus the administrative charge.
3.4 Maya Blue Dive Center reserves the right to change the dive site without notice, due to safety issues, and changes by local and/or federal government including the public and private owners of the cenotes.
3.5 In case the client is found to be under alcohol, drugs or any influence, prior or during the activity. This activity will be immediately cancelled and no refund will be given.
3.6 Maya Blue Dive Center will not be responsible for any client that commits any illegal act. This may result in the client being excluded from the activity without refund.
3.7 Clients that fail to meet the performance requirements at any activity, on sole discretion of the instructor, Maya Blue Dive Center reserves the right to charge for repeating the activity. The rate will be the same and not exceed the rate of the booked activity. Dependent on the circumstances and judgement of the Maya Blue Dive Center staff this can be reduced.
3.8 In all matters regarding bookings and/or any direct purchases Maya Blue Dive Center decision is final.
4. Force Majeure
No refunds or compensation will be allocated in case of cancellation due to circumstances beyond the control of Maya Blue Dive Center. Encompassing but not limited to war, threat, riots, disputes, civil strikes, terrorist activity, fire, natural or nuclear disasters, technical problems with transport, docks or airport closures, adverse weather conditions or any other similar conditions.
5. Procedure changes and cancellation made by the client
5.1 Maya Blue Dive Center requires payment from a client to secure the booking for a personalized activity. The client’s booking will be confirmed and charges will be applied for spaces booked. Resulting in formal scheduling of activities and/or training with Maya Blue Dive Center.
5.2 Cancellation and/or changes will take effect from the moment Maya Blue Dive Center will receive a notice from the client. The client can notice through the contact form on the website https://www.mayabluedivecenter.com/contact-us. Further the client can also call directly on +52 984 238 6756. If the client is in the direct environment, he can also submit the notice at the location of the dive center: Km 93 Carrerera Tulum – Cancun (200 yards before Cenote Tajma-Ha), 77710 Xpu Ha, Quintana Roo in Mexico.
5.3 Upon receival Maya Blue Dive Center the client will receive a formal reply through e-mail or text-message.
5.4 If client is entitles to refund according to the articles in this Cancellation Policy, Maya Blue Dive Center will return the funds towards the credit card that is used for payment or through wire or will make the payment in cash. Maya Blue Dive Center reserves the right to choose the means of payment and will fulfill the payment within 30 days upon receiving the client’s notice.
6. Procedure changes and cancellation made by Maya Blue Dive Center
6.1 In the rare occasion that Maya Blue Dive Center must make changes and/or cancellations, Maya Blue Dive Center will make every effort to notify the client through the e-mail of the client or through text message. Maya Blue Dive Center will include the nature of the change or reasons of the cancellation.
6.2 If rescheduling is an option for both the client and Maya Blue Dive Center, the rescheduling will take place in mutual agreement. Maya Blue Dive Center will provide a notification of the rescheduling to the client.
6.3 If a personalized voucher is applicable in mutual agreement with the client and according to this Cancellation Policy. Maya Blue Dive Center will provide the voucher either through e-mail or other digital means to the client.
6.4 If a refund is applicable in mutual agreement with the client and according to this Cancellation Policy. Maya Blue Dive Center will return the funds towards the credit card that is used for payment or through wire or will make the payment in cash. Maya Blue Dive Center reserves the right to choose the means of payment and will fulfill the payment within 30 days.
